We added two new federal cases to our Oversight Case Law Tracker, expanding this free resource for scholars, practitioners, and policymakers interested in congressional and legislative oversight.

Neguse v. ICE (2025) — Twelve Members of Congress filed suit against U.S. Immigration and Customs Enforcement over a policy requiring seven days’ advance notice before lawmakers can visit immigration detention facilities. The plaintiffs argue that the policy violates a federal appropriations law guaranteeing Members the right to access such facilities without prior notice. The case, filed in the U.S. District Court for the District of Columbia, is currently awaiting a ruling.

United States v. McIver (2024) — This case examines whether a congressional staff member can be compelled to testify about internal committee deliberations during a criminal trial. The court’s decision reaffirms key protections under the Speech or Debate Clause, reinforcing Congress’s constitutional independence in carrying out its legislative functions.
